These Terms of Service ("Terms") govern access to and use of Onyx Network and related services operated by Onyx Agent ("Onyx Agent", "we", "us"). By creating an account or using the service, you agree to these Terms.
1. Eligibility and Account
You must be at least 18 years old and authorized to act on behalf of your company. You are responsible for account credentials and all activity under your account.
2. Scope
These terms apply to all Onyx Agent services including Onyx Network (network.getonyxagent.com), Onyx Hiring (hiring.getonyxagent.com), Onyx Jobs (onyxjobs.com), the landing page (getonyxagent.com), and the Onyx Agent Chrome Extension.
3. Product Information and Availability
Information on this website is provided for general informational purposes. Product features, pricing, access conditions, and availability may change during beta and controlled rollout phases.
We do not guarantee uninterrupted availability of the website or any product access flow.
4. Early Access and Account Access
Access to Onyx products may be invite-only, provision-based, or approval-based during controlled beta. Submission of a request does not guarantee acceptance or activation.
We may approve, delay, limit, or reject access requests at our discretion, including for trust, safety, abuse-prevention, or operational reasons.
5. Acceptable Use
You may not use the service for unlawful, discriminatory, abusive, or deceptive purposes. You may not attempt to disrupt, reverse engineer, or unauthorizedly access systems or data. Any use that violates applicable employment or data protection law is strictly prohibited. You agree not to:
- Attempt unauthorized access to protected areas, APIs, or accounts
- Use automated tools to scrape, harvest, or enumerate data without authorization
- Misrepresent your identity, role, or affiliation
- Interfere with the website or infrastructure security and availability
6. Customer Data
You retain ownership of data you submit. You grant Onyx a limited license to process that data solely to provide, secure, and improve the service, and to satisfy legal obligations.
7. AI Features
AI outputs are assistive and may contain errors. You are responsible for human review and final hiring decisions. You must not rely on AI output alone for legally significant decisions where law requires additional safeguards. AI-assisted screening must not use sensitive attributes such as age, gender, ethnicity, disability, or religion.
8. Intellectual Property
All software, models, designs, and branding made available through Onyx Agent are the exclusive property of Onyx Agent or its licensors. You receive a limited, non-exclusive, non-transferable right to use the service during your subscription. Nothing in these Terms transfers intellectual property rights to you.
9. Pricing and Fees
The service is currently offered in early access. Pricing, feature availability, and access conditions may change. We will provide reasonable advance notice of material changes to paid plans. Beta/early-access conditions may differ from future commercial terms.
10. Data Privacy and AI Usage Notice
Our collection and use of personal data is described in our Privacy Policy. When using AI features that process candidate data, you acknowledge your responsibility as a data controller or processor under applicable law, including the GDPR where it applies.
11. Service Availability
We aim for reliable operation but do not guarantee uninterrupted or error-free service. We may change or discontinue features at any time.
12. Termination
We may suspend or terminate access for material breach, security risk, legal requirements, or misuse. You may stop using the service at any time.
13. Disclaimer and Liability
The service is provided "as is" and "as available." To the maximum extent permitted by law, Onyx disclaims implied warranties and is not liable for indirect or consequential damages. Mandatory statutory liability remains unaffected.
14. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, unless mandatory consumer protection provisions require otherwise.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice in the application before the changes take effect. Your continued use of the service after the effective date of revised Terms constitutes your acceptance of those changes.
